Terms of Use

These Terms of Use govern access to and use of the TenantSimplified website, web application, mobile applications when available, and related services (“TenantSimplified” or the “Service”). By creating an account, accessing or using the Service, you agree to these Terms. If you do not agree, you should not use TenantSimplified.

1. The Service

TenantSimplified is a software platform designed to help landlords, property owners, property managers and other authorized users organize and manage information relating to properties, units, tenants, owners, leases, rent, invoices, payments, deposits, expenses, maintenance, documents, reports and related activities. Features may vary by subscription plan and may change as the Service develops.

2. TenantSimplified Is a Software Platform

TenantSimplified provides software tools and information-management functionality. Unless expressly stated otherwise, TenantSimplified is not acting as your property manager, real-estate broker or agent, lawyer or legal adviser, accountant, auditor or tax adviser, financial adviser, bank or payment institution, insurance adviser, or government or regulatory authority.

Information, calculations, reminders, reports, templates, generated documents and other outputs are tools intended to assist users and should not replace appropriate professional advice or independent verification where required.

3. User Responsibility

You remain responsible for decisions and actions concerning your properties and business, including information entered into TenantSimplified; rental amounts and payment records; lease terms and renewals; deposits and deductions; taxes and statutory obligations; notices and communications; maintenance decisions; tenant and owner relationships; legal and regulatory compliance; and verification of calculations, reports and generated documents.

TenantSimplified does not guarantee that information entered by users or outputs generated from that information are accurate, complete or legally sufficient.

4. Accounts and Security

You must provide accurate information when creating an account and keep account information reasonably current. You are responsible for maintaining the confidentiality of your login credentials and for activity performed through your account by persons you authorize. You must promptly notify us if you reasonably suspect unauthorized access.

5. Authority to Store Information

You may only enter, upload, store or process information that you are legally entitled or authorized to use. If you provide information concerning tenants, owners, vendors or other individuals, you are responsible for obtaining any consent or other lawful authority required to process that information.

6. Acceptable Use

You must not use TenantSimplified to violate applicable law; infringe another person's rights; upload malicious software or harmful content; attempt unauthorized access; circumvent security or access controls; interfere with operation of the Service; engage in fraud, harassment or unlawful activity; or copy, reverse engineer or exploit the Service except where expressly permitted by applicable law.

We may restrict or suspend access where reasonably necessary to protect TenantSimplified, its users or third parties.

7. Plans, Subscriptions and Features

TenantSimplified may provide free and paid plans with different limits, functionality and eligibility requirements. We may introduce, modify or discontinue features, limits or plans as the Service evolves, subject to applicable law and any specific contractual commitments made to paid customers.

8. User Data

As between TenantSimplified and the customer, customers retain their rights in information and content they submit. You authorize TenantSimplified and its necessary service providers to process your data to operate, secure, maintain and provide the Service. You are responsible for maintaining appropriate independent records or exports of information that is critical to your business.

9. Documents, Reports and Automated Outputs

TenantSimplified may generate or assist with invoices, receipts, reports, reminders, agreements, calculations, summaries or other documents. Such outputs depend on information provided by users and configuration of the Service. You must review important documents, calculations and reports before relying upon or issuing them. Where legal, tax, accounting or regulatory consequences may arise, appropriate professional advice should be obtained.

10. Third-Party Services

TenantSimplified may integrate with or link to services operated by third parties. We do not control independent third-party services and are not responsible for their availability, security, accuracy, terms, acts or omissions. Use of third-party services may be subject to separate terms and privacy policies.

11. Service Availability

We aim to provide a reliable Service, but uninterrupted or error-free availability cannot be guaranteed. The Service may be unavailable because of maintenance, upgrades, technical failures, internet or infrastructure problems, third-party failures, security events or circumstances outside our reasonable control.

12. Intellectual Property

TenantSimplified and its software, design, branding, logos, interfaces and other proprietary materials are owned by or licensed to the owners of TenantSimplified and are protected by applicable intellectual-property laws. These Terms grant permission to use the Service; they do not transfer ownership of TenantSimplified's intellectual property.

13. No Warranty

To the maximum extent permitted by applicable law, TenantSimplified is provided on an “as available” and “as is” basis. We do not warrant that the Service will always be uninterrupted, error-free, completely secure, suitable for every purpose, or that every calculation, report, reminder or output will be accurate. Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded.

14. Limitation of Liability

To the maximum extent permitted by applicable law, TenantSimplified and its owners, operators, affiliates, personnel and service providers will not be liable for indirect, incidental, special, consequential, exemplary or punitive losses arising from use of or inability to use the Service, including, where legally permissible, loss of profits, business opportunities, rent, revenue, data, goodwill or anticipated savings.

TenantSimplified is not responsible for losses resulting from user-entered information, user decisions, missed reminders, incorrect configuration, unauthorized account use, third-party services, internet or infrastructure failures, or reliance on reports, calculations, templates or generated outputs without appropriate verification.

Where liability cannot legally be excluded, our aggregate liability will be limited to the extent permitted by applicable law and, where legally permissible, to the amount paid by the affected customer for the relevant TenantSimplified Service during the 12 months immediately preceding the event giving rise to the claim. Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

15. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless TenantSimplified and its owners, operators and affiliates from third-party claims, liabilities and reasonable costs arising from your unlawful use of the Service, violation of these Terms, infringement of another person's rights, or information or content you submit without appropriate authority.

16. Suspension and Termination

We may suspend or terminate access where reasonably necessary because of a material violation of these Terms, security threats or suspected fraud, unlawful activity, non-payment of applicable charges, misuse that threatens the Service or other users, or requirements imposed by law or competent authorities. Users may discontinue use subject to any applicable subscription conditions.

17. Changes to the Service or Terms

TenantSimplified may modify the Service or these Terms as the Service evolves. Where a change materially affects users' rights or obligations, we may provide notice through the Service or require acceptance of updated Terms where appropriate.

18. Governing Law and Jurisdiction

These Terms are governed by the laws of India. Subject to applicable law and any mandatory dispute-resolution rights, disputes relating to TenantSimplified will be subject to the jurisdiction of the competent courts in Bengaluru, Karnataka, India.

19. Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will continue to apply to the maximum extent permitted by law.

20. Entire Agreement

These Terms, together with the Privacy Policy and any specific subscription or service terms applicable to your account, constitute the agreement governing your use of TenantSimplified.
